The Freedom from Debt Coalition believes that the public and Meralco’s consumers have the right to know all information related to the enforcement of the Supreme Court refund order. We would like to point out that the money in question is the consumers’ hard-earned money. As consumers, we would like to know how much Meralco actually owes them and how will the firm return the said amount to all consumers.

In the interest of the consuming public, the Freedom from Debt Coalition hereby requests the Honorable Commission to provide us the following information:

1. All data related to the computation of the Meralco refund, including the break down of consumers’ energy consumption, actual months covered by the Supreme Court order, and all pertinent and unblemished data regarding the refund.

We believe that accurate information is an absolute necessity before any hypotheses or assumptions are formulated.

2. The plan of the Honorable Commission, independent of Meralco’s, in enforcing the Supreme Court refund order. Further, we would like to ask for the overall scheme proposed by Meralco, which includes the purported Phase II, Phase III, etc.

As Meralco consumers, we want to exercise our right to determine the acceptable mode of refund. But we need to know the entire plan before we can decide what is acceptable for us.

We urge the Honorable Commission to refrain from enforcing any partial refund scheme without first having any overall plan. To do so will mean consigning the interest of consumers to the firm that enriched itself at the expense of the public.

Further, we reiterate our demand that corresponding interest payments accruing to the refundable amount since 1994 should be included in the computation of the refund. Consumers could have spent the money in other productive endeavors. Hence, it is only just and equitable that Meralco pays for the opportunity cost of the refundable amount.

We sincerely hope that the Honorable Commission will act on this request at the soonest possible time.
